Whether measures falling under paragraph 1(a) of the Illustrative List of the Agreement on Trade-Related Investment Measures (1 January 1995) were necessarily inconsistent with Article III(4) of the General Agreement on Tariffs and Trade 1994 (15 April 1994) (‘GATT 1994’).

Whether the interpretation of ‘products in general or local short supply’ in Article XX(j) of the GATT 1994 covered a lack of domestic supply and products at risk of becoming in short supply.

Whether the terms ‘laws or regulations’ in Article XX(d) of the GATT 1994 included international legal instruments.
