The present dispute is submitted to arbitration under the Agreement between the Kingdom of the Netherlands and the Republic of Poland on Encouragement and Reciprocal Protection of Investments of 7 September 1992 (the “ Dutch–Polish BIT” , the “ BIT ” or the “ Treaty” ). 2.
