Whether the decision by the United Kingdom to extradite Soering to the authorities of the United States would, if implemented, give rise to violation of Article 3 of the Convention for the Protection of Human Rights and Fundamental Freedoms (‘the Convention’) as he would face death row once in the United States.

Whether the absence of legal aid in the United States would give rise to a violation of Article 6(3)(c) of the Convention by the United Kingdom as Soering would not be able to secure legal representation.
