Whether the state of emergency declared by Ecuador and the derogations resulting from such measure were in compliance with Article 27 of the American Convention on Human Rights (‘ACHR’).

Whether the victims’ deaths involved an arbitrary deprivation of life in violation of Articles 4 and 1(1) of the ACHR.

Whether the lack of appropriate investigation into the victims’ deaths involved violations to the rights to a fair trial and an effective remedy as protected by Articles 8 and 25 of the ACHR, in relation to Article 1(1) of the same treaty.
