Whether the ill-treatment suffered by the victim violated his rights to humane treatment enshrined in Articles 5(1) and 5(2) of the American Convention on Human Rights (‘ACHR’).

Whether the victim’s mistreatment emotionally affected his next of kin in breach of their right under Article 5(1) of the ACHR.

Whether the investigation carried out with regard to the ill-treatment suffered by the victim breached his rights to a fair trial and effective remedy, as enshrined in Articles 8, 25, and 1(1) of the ACHR.
