Whether the Court had prima facie jurisdiction over the case and whether a dispute continued to exist between the parties.

Whether there was a risk of irreparable prejudice to the rights in dispute and sufficient urgency to warrant provisional measures, in the light of Senegal’s statement that Mr Habré would remain in detention for the remainder of the case.
