Article 68 of the Rome Statute (‘Protection of the victims and witnesses and their participation in the proceedings’), as its name suggests, governs the protection of victims and witnesses. This chapter concerns the protective aspect of Article 68 only; the participation of victims and witnesses in ICC proceedings, provided for in Article 68(3), is commented upon by Claude Jorda and Jérôme de Hemptinne in Chapter 32 of this Commentary.
