Part 1, Establishment of the Court, comprises Articles 1–4. These articles are closely interrelated and deal with the legal status of the Court. Articles 1, 2, and 4 complement Article 3 dealing with the seat of the Court proper. Article 3 deals with three separate questions. In the first paragraph the location of the seat is determined. The second paragraph deals with the conclusion of a Headquarters Agreement with the Netherlands, the Host State.
