Whether the unilateral offer of consent to International Centre for Settlement of Investment Disputes (‘ICSID’) arbitration in the Agreement on Encouragement and Reciprocal Protection of Investments between the Republic of Venezuela and the Kingdom of the Netherlands could be affected by the state’s denunciation of the Convention on the Settlement of Investment Disputes Between States and Nationals of Other States (‘ICSID Convention’).

Whether an ICSID tribunal had jurisdiction over claims brought after the notification of the respondent state’s denunciation of the ICSID Convention but before that denunciation became effective.
