The Fisheries Jurisdiction case between Spain and Canada arose out of an incident in an area which both parties recognized formed part of the high seas: the arrest by the Canadian authorities of a Spanish fishing vessel on the basis of Canadian legislation authorising measures of conservation and management of fisheries in an area beyond Canadian EEZ or fishery jurisdiction.
