Article 31 makes provision for the denunciation of the Convention by any State party, a possibility foreshadowed by the customary rule1 codified in Article 54(a) VCLT.2 The term ‘denunciation’, which is functionally synonymous with ‘withdrawal’,3 ‘denotes a unilateral act by which a party terminates its participation in a treaty’.4 As a general rule, the consequence of a State party’s denunciation of a multilateral treaty, such as the Convention, is that from the date the denunciation takes effect the denouncing State, on the one side, and each of the remaining...
