Human rights treaties specify that States are to not only refrain from certain actions, but are to take measures so that the rights therein are actually respected.1 The wording differs depending on the treaty, but the result, reinforced by the practice of the treaty bodies, is that States are required to take steps in order to be in conformity with the treaty. Under Article 2 of the International Covenant on Civil and Political Rights (ICCPR): Each State Party…undertakes to respect and ensure…the rights recognised in the present Covenant?… Where not already...
