While article 42 ARSIWA concerns the invocation of responsibility by States specially affected by the breach of an international obligation owed to a group of States or the international community as a whole, article 48 concerns the situation of States other than injured States, but to whom the obligation breached is also owed. The term ‘injured State’ could be used also in relation to this category of States, for they are also affected by the breach.
