The existence of a plurality of States ‘injured by the same internationally wrongful act’ is envisaged by the ILC in article 46 ARSIWA. Prima facie, the simplicity of the wording suggests that there is no specific problem with the existence of a plurality of injured States. Article 46 provides: Where several States are injured by the same internationally wrongful act, each injured State may separately invoke the responsibility of the State which has committed the internationally wrongful act.
