This chapter comments on Article 84 of the Rome Statute of the International Criminal Court. Article 84 governs the revision of a conviction of sentence. Revision is distinct from appeal. It is not based upon any challenge to the trial judgment. Rather, it attempts to review or quash a decision based upon new facts that were not considered at trial, or because one of the judges ought not to have participated in the proceedings. The ad hoc tribunals call this ‘review’. Revision can only be sought with respect to a conviction. It is not available to the Prosecutor in order to challenge an acquittal.
