1 The Scope of Application of the Three Additional Protocols

This chapter discusses the scope and limitations of the application of the two Additional Protocols of 1977 and the Third Additional Protocol of 2005. It explains that some provisions must be implemented amidst peacetime, while other provisions are limited to armed conflict situations. Additional Protocol I focused on international armed conflict, while a particular form of non-international armed conflict had been addressed by the conditions of Additional Protocol II. Meanwhile, the Third Additional Protocol became effective in all situations falling within the scope of the aforementioned Protocols. The chapter also looks into the geographical and temporal scope of application within the sovereign territory.
