Whether, in considering whether an attack against a person’s reputation constituted a violation of Article 8 of the European Convention on Human Rights (‘ECHR’), Romanian courts had taken into account the essential elements to be considered in assessing compliance with the limits of the right to freedom of expression under Article 10 of the ECHR.
