Whether the method of assessment of the identification evidence violated an individual’s right to fair trial under Article 7(1) and non-discrimination under Article 2 of the African Charter on Human and Peoples’ Rights (‘ACHR’).

Whether the alleged violation of the right to fair trial and nondiscrimination fell under the ratione temporis jurisdiction of the African Court on Human and Peoples’ Rights (‘Court’) considering that the alleged violations occurred prior to the date on which the Respondent State made the declaration accepting the Court’s jurisdiction.

Whether a complaint was filed within a reasonable time in conformity with Article 56(6) of the ACHR and Rule 50(2)(f) of the Rules of Court.
