Whether the Prosecutor’s appeal against a decision of the Pre-Trial Chamber taken under Article 53(3)(a) of the Rome Statute was admissible under Article 82(1) of the Statute.

Whether a decision of the Pre-Trial Chamber under Article 53(3)(a) of the Rome Statute requesting the Prosecutor to reconsider her decision under Article 53(1)(b) not to open an investigation on grounds of insufficient gravity could be considered a decision with respect to admissibility for the purposes of Article 82(1)(a) of the Statute.
