Whether a dispute relating to the interpretation or application of the International Convention on the Elimination of All Forms of Racial Discrimination (‘CERD’) existed between two state parties.

Whether parties in a dispute had attempted, prima facie, to engage in negotiations with a view to resolving their dispute, and whether these negotiations were pursued as far as possible by one party pursuant to Article 22 of the CERD.

Whether rights claimed by a party were plausible and whether a link existed between the rights whose protection was sought and the provisional measures requested.

Whether there was a real and imminent risk that irreparable prejudice would be caused to rights whose protection was sought by a party before a court issued its final decision.
