Whether a state applied ad valorem duty rates in excess of bound ad valorem duty rates and combined duty rates in excess of bound ad valorem and bound combined duty rates, in breach of Articles II:1(a) and II:1(b), first sentence, of the General Agreement on Tariffs and Trade 1994 (the ‘GATT 1994’).

Whether a state systematically applied combined duty rates in excess of bound ad valorem or combined duty rates in a significant number of individual tariff lines in breach of Articles II:1(a) and II:1(b), first sentence, of the GATT 1994.

Whether a finding of inconsistency with Article II:1(b), first sentence, of the GATT 1994 was conditional on evidence of actual import transactions concerning products falling within the relevant tariff lines, or on a ‘trade effects’ test.

Whether a temporary reduction of a duty rate could eliminate its inconsistency with Articles II:1(a) and II:1(b) of the GATT 1994.

Whether a Panel could make findings in respect of a duty rate which had not been applied on the date of the Panel’s establishment.
