Whether the Panel erred by concluding that Article VI of the General Agreement on Tariffs and Trade (‘GATT 1994’) could not be applied independently in transitional situations where the Agreement on Subsidies and Countervailing Measures (‘SCM Agreement’) was not applicable pursuant to Article 32.3 of the SCM Agreement.
